INCONVENIENT SIGNATURES --- THE NURSING HOME WAR OVER ARBITRATION AGREEMENTS

An offering in the ADR Professor Series!

Joe Manuel is the “ADR Professor”

The Professor explores the various battles in this legal war. He takes the student upon a journey that surveys this legal landscape that is littered with the remnants of failed arbitration agreements. A must for those who practice in the arbitration arena and entertaining even for those who do not.

For years, the battle has raged over whether arbitration clauses contained within nursing home contracts are per se invalid for a number of reasons. Our Tennessee Supreme Court has recently settled some of these issues, but the war continues over other issues such as whether the arbitration provision is an adhesion contract and whether its terms are unconscionable in a specific instance.
